All HP has to do is show that it has actually built some marketable software out of the $10.3 billion acquisition. The question is, where is that software?Stanley Morrical isn’t convinced such software exists, so last week he sued HP in Federal court in San Jose, CA, accusing the company of fraud. Morrical is not buying HP’s claims that Autonomy executives duped it into buying the British software maker last year through “serious accounting improprieties, misrepresentation and disclosure failures.” HP has asked US and British regulators to investigate for criminality.HP’s Alleged Cover UpHP says it will take an $8.8 billion write off from the purchase of Autonomy, most of it due to paying too much for Autonomy because of alleged shenanigans with Autonomy’s accounting prior to HP’s acquisition of the UK company. But Morrical says all of these allegations are covering up HP’s incompetence in failing to upgrade Autonomy’s software and release it as a sellable product.“In an effort to conceal their own gross mismanagement, fraudulent conduct and potential exposure to securities claims, HP’s officers and directors have blamed the entirety of the $8.8 billion write-down on accounting issues,” Morrical’s lawsuit says.HP did not respond to a request for comment.The suit’s allegations stem from HP’s announcement in November 2011 that IDOL 10, a major upgrade of Autonomy’s IDOL 7, was ready. In general, IDOL software searches, organizes and manages all data within an enterprise. The upgrade included integration with HP’s data analytics application, acquired that same year with the purchase of Vertica.Where’s IDOL 10?While claiming to have IDOL 10 ready, HP actually had nothing to sell, Morrical is accusing. Essentially, he claims, IDOL 10 was vaporware.“You go out in the market and say it’s available and it’s not,” Aron Liang, an associate at the San Francisco law firm Cotchett Pitre & McCarthy, which is representing Morrical, said. “So either they knew it and they’re lying or they don’t even know what they’re selling, which in some ways may even be worse.”David Schubmehl, a tech analyst for International Data Group, said he was briefed on IDOL 10 in June. However, Schubmehl says he hasn’t talked to any companies using the software.“I can’t confirm that anyone is actually using IDOL 10,” Schubmehl said. “However, I have had briefings about that back in June and it certainly seemed to be part of their big data offerings.”In an interview with the San Jose Mercury News, an HP spokesman declined to comment on the status of IDOL 10.The suit also accuses HP’s leadership of corporate waste and failing to meet their legal obligation to act in the best interest of shareholders.Buying AutonomyHP made the accounting allegations against Autonomy in November of this year, roughly a year after agreeing to buy the software maker. Other tech companies and industry experts have said Autonomy was overpriced.The deal was brokered by HP’s then-CEO Leo Apotheker, who was ousted months later and replaced with ex-eBay Chief Executive Meg Whitman.Whitman, who was on the HP board when the Autonomy deal was approved, takes no responsibility for the purchase and believes HP shouldn’t either. But shareholders aren’t buying it. Others who have filed suits over Autonomy claim they are the real victims and they want their day in court.In the case of Morrical, he also wants to see some real software come out of the deal. Eldemire, regarding the renaming of the Cornwall Regional Hospital in his honour. Addressing a JIS Think Tank at the agency’s Half-Way-Tree Road offices today (April 24), Dr. Ferguson noted that the family has expressed reservations about the renaming based on what is now being said in the public space. “We are ready to move, subject to the willingness of his family. We would not want to rename an institution after someone if his family, at this time, feels that with all that is happening, it would not be in the best interest. There will have to be some discussions with the family with a view of reaching a position,” he stated. The Health Minister said the decision to rename the hospital in Dr. Eldemire’s honour is “not something that we should be arguing about, causing distress to the family and all other well wishers and bringing into question, the good and honourable name of the former Health Minister”. Dr. Ferguson said that Dr. Eldemire is deserving of the honour, based on his work and worth, having served as Minister of Health from 1962 to 1972 and seeing to the modernisation of the country’s health sector in the post-independence period. Eldemire Regional Hospital.This was after discussions with the Prime Minister, the Minister of Local Government, the Mayor of Montego Bay, the Minister of Labour and the Members of Parliament for St. James, and with the approval of the family.Both the name change and the subsequent amendment have been gazetted.

With supply chains disrupted, many customers are approaching us for transport solutions for their cargo. Air Canada and WestJet Airlines are raising fees for passengers to check their bags.The country’s two largest airlines are raising the fee for the first checked bag to $30 from $25, and for the second bag to $50 from $30.Air Canada and WestJet say the increases follow similar fee bumps by major U.S. airline JetBlue Airways Corp. as well as rising fuel prices and other costs.For years, the airlines checked the first bag for free, a policy that largely ended across the industry by 2014.The increases were put in place this week for domestic flight bookings, and with WestJet are effective for international flights booked starting Tuesday.The fees apply to the lowest fare classes at both airlines.
APTN National NewsIn June 13, Chief Adjudicator Daniel Ish issued a memo to the 200 lawyers who represent IAP clients.“The courts have made clear that any assignment of Settlement Agreement funds is contrary to the Financial Accountability Act and the Settlement Agreement,” he wrote. “Thus, assignments or directions to pay third parties are illegal and unenforceable. In no circumstances should legal counsel pay compensation funds to anyone other than the claimant, beyond approved legal fees.”Without naming names, the chief adjudicator confirmed that a number of the complaints made by the former students had been reported to him.“It has been brought to my attention that at least one firm has delivered cheques for compensation funds, payable to the claimant, to a third party for ‘delivery’ to the claimant. The claimant is then asked to endorse the cheque to the third party for services rendered in processing the IAP claim,” Ish wrote. “This must certainly be an unethical practice. All compensation funds should be paid directly to the claimant and if any amount is payable to a third party, it is a matter to be dealt with between the claimant and the third party without assistance being provided by claimant’s counsel to the third party.”He stated that lawyers could see their fees reduced if they did not provide adequate representation. Then he stated that he had received reports from adjudicators that clients were not receiving adequate representation.“Canada’s 15 per cent contribution toward legal fees is not a guaranteed minimum irrespective of the adequacy and quality of legal services provided to claimants,” Ish wrote.The chief adjudicator explained what had prompted him to write the memo.“In some situations, a 15 per cent fee is not fair and reasonable because it over-compensates for the services provided,” he told the IAP lawyers. “While it is hoped that these situations are not common, they certainly include cases where counsel has had no communication whatever prior to the day of the hearing, where counsel appear at a hearing with the wrong claimant (in one case on more than one occasion relating to the same file), delays in the prosecution of files attributable totally to counsel inaction and false or altered certifications on applications.”Oversight Committee minutes add more detail.The minutes of a meeting on June 21 noted the memo and summarized it for the committee.“As examples of conduct that might warrant such a reduction, he cited lawyers who repeatedly attended with the wrong client, claims where the application form bears no resemblance to the case, and application forms where the lawyers’ certification is signed by someone else, photocopied, or falsified. All of these are, regrettably, actual situations that have occurred.”Minutes of an earlier meeting show that the committee was getting impatient with some firms.“Six law firms are responsible for 70 per cent of the cases on hold. Meetings are being held with each. The Court Monitor may have to be engaged if the lack of response remains. Disclosure of the names of the firms, possibly on the website, was suggested.”
